Prescription as a Key Cultural Institution - Guidelines for Applicants

The Copyright Amendment Act 2006 introduced a number of new provisions to allow key cultural institutions to make preservation copies of material that is of cultural or historical significance to Australia.

Key cultural institutions are deemed, for the purposes of the provisions, as those libraries and archives that have a statutory function of developing and maintaining a collection (e.g. the National Library of Australia, State Library of Victoria).

The provisions also provide that the Attorney-General may, through the regulation making power, prescribe particular bodies administering libraries and archives to be key cultural institutions.

These guidelines were prepared to help such bodies to understand the preservation copying provisions in the Copyright Act, and to assist preparation of applications for prescription under the regulations as a key cultural institution.
