Outline of communication 1372/2005 - Concerning removal to Turkey

The communication concerns the potential removal from Australia of a family consisting of parents and two children. The parents and the younger child have no entitlement to remain in Australia
.
The elder child was born in Australia, and automatically obtained Australian citizenship on his tenth birthday, by virtue of having been ordinarily resident in Australia for ten years from the date of his birth.

The communication alleges that Australia will breach Articles 17, 23(1) and 24(1) of the International Covenant on Civil and Political Rights should the parents and the younger child be removed from Australia, separating them from the elder child.
