Outline of communication 1429/2005 - Concerning removal to Colombia

The communication concerns the potential removal from Australia of a family consisting of a grandmother, parents and two children.

The father arrived in 1997 and his mother, wife and two children arrived in 1998. The applicants’ applications for protection visas were refused. A subsequent appeal to the Migration Review Tribunal was unsuccessful. The applicants are no longer entitled to remain in Australia.

The communication alleges that Australia will breach Articles 7, 9(1), 9(4) and 24(1) of the International Covenant on Civil and Political Rights should the family be removed from Australia.
