Outline of communication 1442/2005 concerning removal to China


The communication concerns the potential removal from Australia of a person whose application for a protection visa has been refused.

The author of the communication has exhausted all domestic remedies in Australia and has no entitlement to remain in Australia.

The author alleges that Australia will breach Articles 6 and 7 of the International Covenant on Civil and Political Rights (ICCPR) should she be removed from Australia and returned to her country of origin. The author also alleges breaches of Articles 9(1) and 9(4) of the ICCPR in relation to her detention in Australia.
