
The author of this Communication alleges that Australia has breached Articles 14(7) and 9(1) of the International Convention on Civil and Political Rights, relating to double punishment and arbitrary detention respectively.
The author is being detained after having served the full-term of a prison sentence on the basis that he is determined to be a danger to the community according to state legislation on serious sex offenders.
The author alleges that he is being punished again for an offence for which he has already been finally convicted and served his sentence under Australian laws, and that he is being imprisoned arbitrarily.
