Outline of communication 316/2007 under the Convention against Torture and Other Cruel, Inhuman and Degrading Treatment or Punishment

The communication, received in May 2007, concerns the potential extradition of an adult man (‘the author’).

The Minister for Justice and Customs has determined that the author should be surrendered under the Extradition Act.  The author has appealed this decision to the Federal Court.

The communication alleges that Australia will breach article 3(1) of the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment if the author is extradited.
