Outline of communication 324/2007 under the Convention against Torture and Other Cruel, Inhuman and Degrading Treatment or Punishment

This communication, received in June 2007, concerns the potential removal from Australia of an adult man (‘the author’).

The author arrived in Australia in 2002 and has made claims for a Protection Visa which have been considered by the Department of Immigration and Citizenship, the Administrative Appeals Tribunal, and the Minister for Immigration.

The author alleges that Australia will breach article 3(1) of the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment if he is removed from Australia.

An Interim Measures Request has been made seeking that Australia refrain from removing the author from Australia whilst the complaint is under consideration by the Committee.
