Outline of communication 35/2005 under the international Convention on the Elimination of All Forms of Racial Dicrimination

The author of the communication, on behalf of a community of people making up a registered Aboriginal corporation, alleges that their rights under the International Convention on the Elimination of All Forms of Racial Discrimination (‘CERD’) have been breached, by the refusal of other organisations and government agencies to recognise them as being Aboriginal persons.

The author alleges that members of the community are refused recognition as Aboriginal persons, resulting in discrimination prohibited under CERD.

The communication alleges that Australia has breached article 2(1)(b) and (c), article 4(c), and article 5(c) and (d) of the CERD.
