Exposure draft

The main purpose of the Telecommunications (Interception and Access) Bill 2007 is to transfer the national security and law enforcement-related provisions from the Telecommunications Act 1997 (the Telecommunications Act) to the Telecommunications (Interception and Access) Act 1979 (the TIA Act) to complete the development of a single legislative framework for national security and law enforcement agencies to access telecommunications-related data.

The Bill also contains a number of additional amendments to refine the operation of the existing Act.

This Bill represents the second stage of the Government’s legislative implementation of the recommendations in the Report of the Review of the Regulation of Access to Communications made by Mr Anthony Blunn AO, published in August 2005.

Following consultation in early February 2007, involving the telecommunications industry, law enforcement and national security agencies, there have been a number of changes made to the attached Exposure Draft so as to address issued that were raised.

As a result of those changes the Attorney-General has revised the date for the Bill to be introduced into Parliament to the Winter Parliamentary sitting period commencing on 8 May 2007.
