
On 5 November 2004 Council dispatched a letter of advice to the Attorney-General which reviews the binding financial agreements provisions in Parts VIII and VIIIA of the Family Law Act 1975. Council’s two major conclusions were that the provisions relating to binding financial agreements allow people greater control and choice over their own affairs in the event of marital breakdown, and secondly that there are appropriate checks and balances in place or soon to be implemented to deal with any attempts to misuse the provisions.
