This page provides information about governance and administration arrangements for Christmas Island.
Following the World War II Christmas Island came under the jurisdiction of the new British Colony of Singapore. Before its transfer to the Australian jurisdiction from 1 January 1958, the Island existed as a separate Crown colony, its transfer to Australia was finalised on 1 October 1958. That date is still celebrated on the first Monday in October as Territory Day. The Singapore administration was paid UK£2.9m in compensation for lost revenue as part of this transfer process.
The Christmas Island Act 1958, administered by the Attorney-General's Department (AGD) on behalf of the Minister for Home Affairs provides the legislative basis for the Territory's administrative legislative and judicial system. The Minister is responsible for the State-level services in the Territory.
An Administrator appointed by the Governor-General is the most senior Australian Government representative in the Territory and resides on Christmas Island.
Other Australian Government agencies have responsibility for matters within their portfolios.
The Territories Law Reform Act 1992 amended the Christmas Island Act 1958 to replace the previous laws of the Territory which were largely based on the laws of colonial Singapore. The Territories Law Reform Act 1992 applied certain Commonwealth Acts and such laws of the State of Western Australia as are capable of being applied. These actions introduced a modern body of Australian law and was a major step in extending to the residents of the Territory the same rights responsibilities and obligations as enjoyed by their fellow Australians.
The Local Government Act 1995 (WA)(CI) was introduced in 1992. The first Shire Council was elected in 1993. The Shire Council has the same responsibilities as a local government on the Australian mainland.
For the purposes of enrolment and voting in federal elections Christmas Island is an electoral district of the Commonwealth Division of Lingiari in the Northern Territory.
The Attorney-General's Department (AGD) issues a range of information to the public in the form of Community Bulletins and Government Gazettes. These are sent to subscribers and may also be viewed online.
The provision of Australian Government services to the Indian Ocean Territories (IOT) are the responsibility of the relevant Australian Government agency within their portfolios eg. customs, quarantine and taxation.
