The Attorney-General's Department is conducting a review of the Statutory Declarations Regulations 1993 (the Regulations).

In particular, the department is reviewing the list of authorised witnesses contained in Schedule 2 of the Regulations, which sets out the categories of persons before whom a Commonwealth statutory declaration may be made.

As part of the review process, the department invited public submissions in early 2017 on whether the Regulations are still fit for purpose and continue to meet the needs of the community.

The department also invited submissions on suggested additions, deletions or updates to the list of authorised witnesses. Submissions proposing the inclusion of new categories of persons had to demonstrate that a genuine unmet need currently exists in the community that could be fulfilled by the addition of the proposed category of persons.
