This department has reviewed Subdivision A of Division 6 of Part VIIC of the Crimes Act 1914 (Cwlth).

This subdivision allows information about pardoned, quashed or spent Commonwealth convictions to be disclosed to and taken into account by prescribed persons or bodies.

Information is disclosed for the purpose of assessing whether a person is suitable for work with children.

The review sought to establish whether the provisions are helping to protect children from sexual, physical and emotional harm.

The review also sought to establish whether any complaints have arisen as a result of the provisions’ operation, as well as whether bodies that receive information continue to comply with safeguards built into the provisions.

In accordance with section 85ZZGG of the Crimes Act, a written report of the review has been prepared and tabled in both Houses of Parliament.
