NBN Co—report on review of FOI compliance

A government report has found that NBN Co—the company responsible for implementing the National Broadband Network—has fulfilled its responsibilities under the Freedom of Information Act 1982 (FOI Act).

NBN Co is subject to the FOI Act with an exemption for documents relating to its commercial activities.

The former Attorney-General and Minister for Emergency Management tabled the report of a review on 16 August 2012. The review found that NBN Co is achieving a high standard in its administration of the FOI Act, actively assisting applicants.

Considerations of the review included:

  • the number and nature of FOI requests already made to NBN Co
  • the responses to those requests
  • the reasons for any exemptions.

Background information about the legislative requirement for the review:

Mr Stuart Morris QC, former justice of the Supreme Court of Victoria and President of the Victorian Civil and Administrative Tribunal, undertook the review.
