Review of the Greenfields Provisions of the Fair Work Amendment Act 2015
Consultation
On 3 October 2017, Mr Matthew O'Callaghan, a former Senior Deputy President of the Fair Work Commission, was engaged to undertake a review of the greenfields agreement provisions of the Fair Work Act 2009 which were the subject of legislative amendments in 2015.
The Greenfields Agreements Review was a statutory requirement of the Fair Work Amendment Act 2015 (Amendment Act). The Amendment Act provides that the responsible minister must cause an independent review of Part 5 of Schedule 1 of the Amendment Act to be undertaken and completed within two years of its commencement.
Submissions
As part of the review, employee organisations, employer organisations and parties that have experience with greenfields agreement making were invited to provide submissions in response to the Greenfields Agreements Review Background Paper, which included the scope of the review.
Submissions to the review have since closed but remain publicly accessible.

Final report
The review was completed on 27 November 2017, and the final report of the Greenfields Agreements Review was publicly released. The review makes ten recommendations in regard to greenfields agreement making and have been provided to the Australian Government for consideration.
