3665/2019 concerning immigration detention and removal to Vietnam

The authors alleged that Australia violated articles 7, 9, 17, 23, 24 and 26 of the ICCPR, in relation to the authors’ immigration detention in Australia and the proposed removal of one of the authors to Vietnam. The Committee formed the view that the authors’ claims in relation to articles 7 and 26 of the ICCPR were inadmissible. The Committee issued adverse views in respect of articles 9(1) and 9(4) of the ICCPR (read alone and in conjunction with article 24(1)), and article 17(1) (in conjunction with articles 23(1) and 24) of the ICCPR.
