Australian Government response to the Senate Legal and Constitutional Affairs References Committee’s Inquiry report: Current and Proposed Sexual Consent Laws in Australia

On 29 November 2022, the Senate referred an inquiry into current and proposed sexual consent laws in Australia to the Legal and Constitutional Affairs References Committee for inquiry and report by 13 September 2023.

On 20 August 2026, the Australian Government tabled its response to the report.

The Australian Government notes that apart from its limited responsibility for sexual offences, the states and territories have primary responsibility for the legislation and legal frameworks relating to sexual violence, including the legal definition of consent. The Australian Government is committed to working collaboratively with states and territories to improve outcomes for victims and survivors of sexual assault.
