Marriage celebrants​

This activity reviews fundamental aspects of real consent, including parties’ capacity to understand the nature and effect of the marriage ceremony. It does so via several scenarios that authorised celebrants may face, involving:

  • older parties,
  • parties who are hospitalised,
  • the requirement for separate meetings,
  • the issue of forced marriage.

This activity considers offences under the Marriage Act 1961 and some particular offences under the Criminal Code Act 1995 that celebrants should be aware of, and related matters.
