Under the Senate Order on non-corporate Commonwealth entity contracts, we have published a list of non-procurement contracts that we have entered into, such as grants. The list includes contracts of $100,000 or more that have either:

  • been entered into between 1 July 2024 and 30 June 2025
  • not been fully performed as at 30 June 2025.

Most of the listed contracts contain general confidentiality provisions. These are designed to protect confidential information about the parties that could be obtained or generated in carrying out the contract. The reasons for such clauses include:

  • ordinary commercial prudence that requires protection of trade secrets, proprietary information and the like
  • protection of other Commonwealth material and personal information.

Our department's accountable authority has confirmed that the listed contracts do not contain any inappropriate confidentiality provisions.

We estimate the cost of complying with the Senate Order is $4,935. We determined this by calculating the time taken to collect, analyse and compile the information and applying salary costs and on-costs. This includes the coordination costs to table the portfolio's compliance with the Senate Order in the Senate.
