Review of the Building and Construction Industry (Improving Productivity) Act 2016

Closing date
On 6 December 2018, the Australian Government tabled the Review of the Building and Construction Industry (Improving Productivity) Act 2016. The review found that the Australian Building and Construction Commission activities are consistent with its role as a full-service regulator, and the higher penalties applying to the sector should be retained.

Review of Workplace Health and Safety laws in the construction industry

Closing date
In 2018, the national review of the Work Health and Safety (WHS) regulatory framework in the building and construction industry (the review) was completed.  The review was conducted by Seyfarth Shaw Australia with assistance from the former Department of Jobs and Small Business.

Deferred prosecution agreement scheme code of practice

Closing date
In 2018, feedback was sought on the draft code of practice for the Deferred Prosecution Agreement (DPA) scheme. This consultation will help to inform the final code of practice. The final code will be published when the scheme commences.

Review of financial hardship arrangements

Closing date
On 28 March 2018, the Attorney-General announced that the Department would lead a review into hardship arrangements and how they interact with the consumer credit reporting framework. A discussion paper sought public submissions and outlined the review process and key issues relevant to the review.

Review of Security of Payment Laws

Closing date
In 2017, the Government commissioned the national Review of Security of Payment Laws (the Review) to examine ways to improve consistency in security of payment legislation and enhance protections to ensure subcontractors get paid on time for work they have done. The final report was published 21 May 2018.

Recognition and enforcement of foreign judgments

Closing date
In 2018, the Attorney-General’s Department negotiated a draft convention to establish uniform rules for the recognition and enforcement of foreign judgments in civil or commercial matters (the Hague Conference Judgments Project)

Reforms to the Native Title Act 1993

Closing date
The page outlines the process of proposed reforms to the Native Title Act 1993 which occurred through the release of an options paper and invitation for consultation. The page links to the submissions received in response to this options paper. The page also summarises the outcomes of the exposure draft’s consultation and the introduction of the Bill into the House of Representatives and the Senate.

Review of the Greenfields Provisions of the Fair Work Amendment Act 2015

Closing date
In 2017, Mr Matthew O'Callaghan was engaged to undertake a review of the greenfields agreement provisions of the Fair Work Act 2009 which were the subject of legislative amendments in 2015. As part of the review, employee organisations, employer organisations and parties that have experience with greenfields agreement making were invited to provide submissions.

Exposure draft for Family Law Amendment (Family Violence and Cross-examination of Parties) Bill 2017

Closing date
On 17 July 2017, the proposed legislation to prevent direct cross-examination where there is family violence, was released for public consultation.

APEC Cross Border Privacy Rules – Australia’s participation

Closing date
In July 2017, the Australian Government invited businesses and interested stakeholders to comment on a discussion paper about Australia's participation in the Cross Border Privacy Rules system. The system was developed by participating APEC economies with the aim of building consumer, business and regulator trust in cross border flows of personal information.

Proposed amendments to the foreign bribery offence in the Criminal Code Act 1995

Closing date
In 2017, the Australian Government explored possible reform options to improve the effectiveness of the offence in addressing foreign bribery, and to remove unnecessary barriers to successful prosecution.

Proposed model for a deferred prosecution agreement scheme in Australia

Closing date
In 2017, a public consultation paper was released on a proposed model for a Deferred Prosecution Agreement (DPA) scheme to facilitate a more effective and efficient response to corporate crime by encouraging greater self-reporting by companies.

Proposed amendments to the Family Law Act 1975 to respond to family violence

In 2016, the Australian Government invited public comment on an exposure draft of proposed legislative amendments to the Family Law Act 1975 that would improve the family law system’s response to family violence.

Review of Safe Work Australia’s role and functions

Closing date
On 8 November 2016, the report on the Review of Safe Work Australia's Role and Functions was tabled in Parliament. The Review was a requirement of section 72 of the Safe Work Australia Act 2008 (Cth) (SWA Act).
